The HITECH section of the American Recovery and Reinvestment Act of 2009 (ARRA) mandated some very significant changes to the HIPAA regulations. The most significant ones change the role of the Business Associate, increase the fines and enforcement and require both BAs and CEs to self-report breaches to HHS and the media. Business Associates are now responsible to HHS and their clients for compliance. Regulations require Business Associates to have written programs, staff training, reporting of breaches and many safeguards that until now have not been required of BAs.Your clients (healthcare practices) are required by regulation to verify that you, as their business associate, are compliant with the new HIPAA regulations in order to continue doing business with you. 2. Explain responsibility and risks of the BA.
3. Discuss BA contractual changes necessary as a result of the HITECH Act and HHS regulations.
4. Describe unacceptable behaviors and actions to facilitate employee training and program administration in your office and if employees go to the practice.
5. Be able to assess when you need to contact an attorney.
6. List the requirements Covered Entities must meet and how the BA can/must assist them based on the duties performed for the practice.
7. Describe the BA role related to breaches and incidents – contract VS regulation.
8. Recall the penalties and enforcement actions outlined in the HITCH rules, and by State and Federal agencies.
